Legal & privacy

Welcome to BizWealth FP, operated by EOW MARKETING SERVICES INC., a Delaware corporation. These terms explain how you may use our website and services. By using the website, you agree to these terms to the extent permitted by law. If you do not agree, please do not use it. Our services are intended for adults aged 18 or older in the United States.

These terms include individual arbitration and a class-action waiver, with a 30-day right to opt out. The arbitration agreement applies only when you affirmatively accept it through our service sign-up or request process; merely browsing does not establish that acceptance. Please read “Dispute resolution and arbitration agreement” below.

What we provide

We provide educational articles, tools and assessments to help you explore financial and business planning topics. When available, you may also apply to meet a participating financial advisor through our introduction service.

Our content and assessment results are general information, not individualized financial, investment, tax or legal advice. BizWealth FP is not a financial planner, broker, tax advisor or law firm, and EOW MARKETING SERVICES INC. is not registered as an investment adviser. An introduction is a connection to an independent professional, not investment advice from us. We do not manage investments, hold client assets or recommend specific securities. Using our website does not create an advisory, fiduciary, attorney-client or other professional relationship with us.

Your circumstances are unique. Information and strategies discussed on this website may not suit your needs. Before making a financial decision, verify the information and consult a qualified professional who understands your situation. Our resources support your understanding; they do not replace professional judgment or tools you use to make decisions, and must not be presented as personalized advice to your own clients.

Advisor introductions and how we are paid

Participating advisors pay us onboarding fees and fixed fees for leads or agreed lead packages. We are paid whether or not you become an advisor's client. These payments support our introduction service and give us an incentive to introduce visitors to participating advisors.

Our introductions are limited to participating advisors and do not compare every advisor in the market. Participation is not a guarantee of suitability, performance or results. Before you authorize an introduction, we identify the recipient, explain what information will be shared and disclose the compensation arrangement and any material effect on selection.

Our matching criteria include an advisor's regulatory and compliance record, experience with the prospect's needs or market segment, geographic location, the prospect's investable assets, and both parties' preference for remote or in-person meetings. We are developing and testing our matching process. Availability and participating-advisor arrangements may affect the options offered; we explain any material payment or budget effect on your introduction before you authorize it. These criteria do not establish a ranking of all advisors or a guarantee about an advisor's conduct.

We do not monitor an advisor's ongoing performance, manage your account with them or provide advice about specific investments. Review the advisor's registration, disclosures, qualifications and fees before hiring them. Any description of an advisor's regulatory or fiduciary status relates to that advisor and the services they agree to provide, not to BizWealth FP.

You decide whether to contact or hire an advisor. An advisor's services, fees and obligations are governed by your separate agreement with that advisor. Any charge to you for a BizWealth FP service will be disclosed before you agree to it.

Using our content and tools

You may use our content for your own personal or internal business learning under a limited, non-exclusive, non-transferable permission. Please obtain our permission before republishing it, selling it or using it in a competing product. Content, software, designs, logos and trademarks remain the property of us or their respective owners. No ownership or trademark rights are transferred to you. Keep copyright and other ownership notices intact. Do not copy or modify our software, reverse engineer it or attempt to obtain its source code, except where applicable law allows this despite a contractual restriction.

Estimates and assessment results depend on the information and assumptions used. They are not predictions or recommendations and may not reflect your circumstances or later changes in law. Verify information relevant to your decisions and seek appropriate professional advice.

Your responsibilities

Provide accurate information and share information about other people only if you have authority to do so. Do not misuse the website, interfere with its security, introduce malicious software, impersonate others, or collect other visitors' information without permission. Do not scrape, harvest or use bots to extract content or personal information without our written permission, bypass access restrictions, overload the service or use it unlawfully. Ordinary indexing by search engines that follow our published crawling instructions is permitted. These restrictions do not limit activity that applicable law protects.

Feedback and public submissions

If you voluntarily send suggestions or product feedback, you allow us to use, adapt and share it to develop and promote our services without payment or an obligation to use it. You retain ownership and grant us a worldwide, non-exclusive, royalty-free, perpetual license for those purposes, including use by providers acting for us. This permission does not cover private assessment answers, advisor-introduction details or personal information handled under our Privacy Policy, and it is not permission to publish an identifiable testimonial.

If we enable comments, reviews or other public contributions, post only material you have the right to share. Do not post unlawful, deceptive, infringing, threatening or abusive material, spam, or another person's private information. You retain ownership and give us permission to host, display, format and distribute your contribution for the feature where you submitted it. Public posts may be copied by others. We may remove content or restrict posting for violations, legal reasons or service management, but do not promise to review every submission. Removing your contribution ends that permission except for reasonable backups, legal records and copies already distributed. Contact us to report a problem.

Privacy and communications

Our Privacy Policy explains how we handle personal information and tracking. Requesting a response or introduction does not automatically subscribe you to marketing emails. You can unsubscribe from marketing using the link in an email. Phone-marketing consent, when offered, is a separate optional choice. Advisor-sharing permission and browser tracking choices are handled separately.

Electronic communications and notices

We may send service messages by email and publish general notices on the website. Marketing permission remains separate. A separate electronic-delivery choice, when presented, covers agreements, disclosures and legal notices for the service you request; simply browsing the website does not replace any affirmative consent required by law.

To receive and keep these records, you need an active email address, internet access, a current browser that displays HTML, and the ability to save or print the records. You can request a free paper copy, update your email or withdraw electronic-delivery consent by emailing info@bizwealthfp.com or writing to the address below. Withdrawal applies after we have had a reasonable time to process it and does not invalidate earlier records. We do not charge for withdrawal. If a service needs electronic delivery, we will explain any resulting service limitation before you consent. If technical requirements materially change, we will notify you and obtain renewed consent when required.

Send formal notices to info@bizwealthfp.com with the subject “Legal notice,” or to EOW MARKETING SERVICES INC., 1207 Delaware Ave, Suite 3693, Wilmington, DE 19806. We send individual notices to the most recent email or postal address you provide. Email notice takes effect when delivered to the designated inbox without a delivery-failure notice; postal notice takes effect on confirmed delivery. A notice posted on the website takes effect on its stated date, subject to any additional notice the law requires. These provisions do not replace rules for serving court documents.

Other websites and service availability

Links, embedded content and advisor websites may be operated by other businesses with their own terms and privacy practices. We do not control their content, availability or conduct. A link is not by itself an endorsement or a guarantee; any paid introduction relationship is disclosed as described above.

We may change, suspend or discontinue features, or suspend or end access for a breach of these terms, misuse, security concerns or a business or legal reason. We will provide notice when reasonably practicable and as required by law. You may stop using the service at any time. Ending access does not remove accrued rights or obligations, privacy rights, or any refund or other remedy the law requires.

Warranties and responsibility

We aim to provide useful, accurate information, but provide the website, content and tools “as is” and “as available.” We do not guarantee that they will be complete, current, secure, uninterrupted or error-free, or that an assessment or introduction will produce a particular outcome. To the extent permitted by law, we disclaim express and implied warranties, including merchantability, fitness for a particular purpose and non-infringement. No informal statement creates a warranty that these terms do not provide.

You remain responsible for your financial decisions. We do not promise gains or protection from losses. Subject to the exceptions below, we are not responsible for indirect, incidental, special, consequential or punitive losses, including lost profits, lost data or lost opportunities, arising from use of the website or reliance on its general information. Our total liability for claims arising from the website, content and tools is limited to $100.

The loss exclusions and $100 cap in the preceding paragraph do not apply to claims arising from our advisor-introduction service. They also do not limit liability for our fraud, willful misconduct or gross negligence, or any liability, remedy or right that applicable law does not permit us to exclude or limit. Other mandatory consumer protections remain available.

Indemnification

To the extent permitted by law, you agree to defend and reimburse EOW MARKETING SERVICES INC. and its officers, directors and employees for third-party claims, damages and reasonable legal costs caused by your unlawful use of the service, your material breach of these terms, or content you supply that infringes another person's rights. This does not apply to a claim caused by our negligence, misconduct or breach, or to your lawful exercise of consumer or privacy rights.

We will promptly notify you of a covered claim and reasonably cooperate with its defense at your expense. You may control the defense with suitably qualified counsel; we may participate at our own expense. Neither party may agree to a settlement imposing an admission, payment or other obligation on the other without that party's written consent, which will not be unreasonably withheld.

Dispute resolution and arbitration agreement

This section constitutes the “Arbitration Agreement” between you and EOW MARKETING SERVICES INC., operating as BizWealth FP (“we,” “us” or “our”). It applies only if you affirmatively accept these Terms and do not exercise the right to opt out described below. Merely browsing the website does not constitute acceptance of this Arbitration Agreement.

FOR CLAIMS SUBJECT TO THIS ARBITRATION AGREEMENT, YOU AND WE WAIVE THE RIGHT TO A TRIAL BEFORE A JUDGE OR JURY AND AGREE TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION. CLASS, COLLECTIVE AND REPRESENTATIVE PROCEEDINGS ARE WAIVED TO THE EXTENT PERMITTED BY APPLICABLE LAW, SUBJECT TO THE EXCEPTIONS BELOW.

(a) Claims subject to arbitration

Except as otherwise provided in this Arbitration Agreement, any dispute, claim or controversy arising out of or relating to these Terms, your use of our website, assessments or services, or any email, telephone call, text message or other communication from us or persons acting on our behalf shall be resolved by binding arbitration. This includes related claims involving our employees, agents, successors or assigns acting in those capacities. This Arbitration Agreement shall be construed broadly, subject to applicable law. It does not bind an independent participating advisor or replace any agreement between you and that advisor.

(b) Informal resolution

Before commencing arbitration, the party asserting a claim shall provide written notice describing the dispute and the relief requested. Notices to us shall be sent to info@bizwealthfp.com; notices to you shall be sent to the contact address you provided. The parties shall attempt in good faith to resolve the dispute within 30 days after receipt of notice. This process shall not prevent either party from filing a claim to preserve a legal deadline, seeking urgent relief or using an eligible small-claims court.

(c) Administration and procedure

The Federal Arbitration Act shall govern this Arbitration Agreement and any arbitration conducted under it. Arbitration shall be administered by JAMS, an independent provider of arbitration and mediation services, under its Streamlined Arbitration Rules and Procedures, as modified by this Arbitration Agreement and applicable law. We agree to provide the safeguards in the JAMS Consumer Minimum Standards of Procedural Fairness for individuals using our educational or introduction services.

One neutral arbitrator shall be selected under JAMS’s rules, with both parties given an opportunity to participate in the selection. Questions concerning jurisdiction and arbitrability shall be governed by JAMS’s rules and applicable law. Either party may be represented by counsel. The parties shall have a reasonable opportunity to exchange relevant, non-privileged information. You may elect a remote hearing or a hearing in the county where you reside, unless the parties agree otherwise. If JAMS is unable to administer the dispute, the parties may agree on an alternative neutral provider offering equivalent consumer safeguards. Neither party may impose a replacement unilaterally. If no agreement is reached within 30 days after notice of JAMS’s inability, either party may proceed in court.

(d) Fees, remedies and award

For arbitration initiated by you, your required filing fee shall not exceed $250 or the filing fee for a comparable action in your local court, whichever is less. We shall pay that fee if you cannot afford it. We shall pay all remaining JAMS filing, case-management and arbitrator fees, and all such fees for arbitration initiated by us. Each party shall bear its own attorneys’ fees and expenses except as otherwise provided by applicable law. You shall not be required to pay our attorneys’ fees merely because you do not prevail.

The arbitrator may award any individual remedy available under applicable law, including statutory damages and attorneys’ fees where authorized, and shall issue a reasoned written award. The award shall be final and binding, subject to applicable law. Judgment on the award may be entered in any court having jurisdiction.

(e) Individual proceedings

Claims shall be brought solely in the parties’ individual capacities. To the extent permitted by applicable law, the arbitrator shall not conduct a class, collective or representative proceeding, consolidate unrelated parties’ claims without all affected parties’ consent, or award class-wide relief. These restrictions do not waive any remedy or right that cannot lawfully be waived. Claims properly heard in court are not subject to a separate jury-trial waiver under these Terms.

(f) Exceptions and court proceedings

Either party may bring an eligible individual claim in small-claims court. Claims by either party alleging infringement or misappropriation of a patent, copyright, trademark or trade secret are excluded from arbitration. Either party may seek temporary or emergency equitable relief from a court to preserve the status quo pending arbitration without waiving arbitration of the remaining dispute. Court proceedings shall be subject to the “Governing law and courts” section below and its mandatory consumer-law exceptions.

Nothing in this Arbitration Agreement prevents a complaint to a government agency or regulator, waives a right that applicable law makes nonwaivable, or limits a right to seek public injunctive relief. Any claim or request for relief that cannot lawfully be arbitrated may proceed in a court with jurisdiction.

(g) Privacy and confidentiality

JAMS and the arbitrator shall maintain confidentiality as provided in JAMS’s rules. The arbitrator may issue appropriate orders protecting privileged material, personal information, trade secrets and other confidential information. This provision does not prohibit lawful reports to regulators, protected disclosures, consultation with legal or other professional advisors, or disclosures required by law or reasonably necessary to pursue or defend a claim or enforce an award.

(h) Severability

If any provision of this Arbitration Agreement is held invalid or unenforceable, it shall be severed to the extent necessary and the remaining provisions shall remain in effect. If a restriction on class, collective or representative proceedings is unenforceable as to a particular claim or request for relief, that claim or request shall proceed in court and any remaining claims subject to an enforceable arbitration agreement shall remain in arbitration.

(i) Right to opt out

You may opt out of this Arbitration Agreement and its class-action waiver within 30 days after first affirmatively accepting these Terms. Send an email to info@bizwealthfp.com with the subject “Arbitration opt-out,” your name, the email address used for the service and a statement that you opt out. No reason, fee or postal delivery is required. We will acknowledge receipt. Opting out shall not affect access to our services or the remaining Terms.

(j) Survival, changes and information

This Arbitration Agreement shall survive termination of your use of our services. Material changes require your affirmative acceptance and a new 30-day opportunity to opt out; they shall not apply retroactively to an existing dispute. Any termination of this Arbitration Agreement by us shall take effect no earlier than 30 days after notice is posted on our website and shall not affect a claim of which either party gave written notice before termination took effect.

JAMS rules and filing information are available through the links above and at JAMS’s case-submission page. Copies are available from us on request.

Governing law and courts

Delaware law governs these terms, without regard to its conflict-of-law rules and without displacing mandatory protections that apply where you live. Federal law governs the arbitration agreement as described above.

For disputes that are properly heard in court, you and we consent to the state courts in New Castle County, Delaware, or the U.S. District Court for the District of Delaware where it has jurisdiction. This choice does not limit your right to use an eligible small-claims court or any court available under mandatory consumer law. It does not change the consumer hearing-location choice for arbitration.

Mobile applications, if offered

These terms also apply to an official BizWealth FP app if we make one available, subject to any additional terms shown before download or use. We grant you a limited, non-transferable right to use it on a device you own or control, in accordance with the applicable app-store usage rules. The app agreement is with EOW MARKETING SERVICES INC.; the app store does not operate our service.

We, rather than the app store, are responsible for any app support we undertake and for app-related product, consumer-protection or intellectual-property claims as required by law. If an Apple App Store app fails to meet an applicable warranty, you may notify Apple for a refund of the purchase price, if any; to the extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these app terms and may enforce them. App-store terms, third-party service terms and applicable export restrictions also apply. Questions or claims about our app should be sent to info@bizwealthfp.com. A future app's additional collection or permissions will be disclosed before use.

Changes to these terms

We will post changes with an updated effective date and give reasonable advance notice of material changes, by email or a prominent website notice as appropriate. Changes apply prospectively and do not change the rules for an existing dispute. Continuing to use the service after the stated effective date signifies acceptance of updated terms to the extent permitted by law; where affirmative agreement is required, we will ask for it. If you do not agree, stop using the affected service. A material change to the arbitration agreement requires your affirmative acceptance and a new 30-day opt-out opportunity.

General terms

These terms and any additional service terms you expressly accept form the entire agreement about the covered service and replace earlier understandings on that subject. Our Privacy Policy continues to govern our handling of personal information. A separate agreement with an advisor governs the advisor's services. If additional terms conflict, the more specific terms apply only to that service.

If one provision cannot be enforced, the remaining provisions continue to apply unless the dispute-resolution section provides otherwise. A delay or failure to enforce a right does not waive it. Any waiver must be in writing and applies only to the matter identified.

You may not transfer these terms without our written consent. We may transfer them with our business or the relevant service, provided the successor assumes our obligations and your mandatory rights are preserved. We will give notice where required. Provisions that by their nature need to continue after use ends survive, including ownership, authorized feedback uses, accrued payment or reimbursement obligations, liability limits, applicable dispute provisions and these general terms.
